Non resident surcharge: the clerk publishes that beginning April 1, 2026, if neither applicant can prove Texas residency to the County Clerk, an additional $100 fee is assessed at issuance under Texas Local Government Code 118.018(3)(d). Acceptable proof includes a Texas driver's license, Texas ID, Texas handgun license, vehicle registration, property tax or homestead documentation, voter registration, military orders showing Texas as home of record, income tax documents, a recent pay stub or employer letter, receipt of benefits from a Texas state agency, or utility bills showing a 12 month history. PO Box addresses are not accepted. Office hours published as Monday to Friday 8:00 am to 5:00 pm on the marriage license page. Applicants must not have divorced within the last 30 days without a waiver.
